Under Australian Privacy Principle 6, an APP entity “must not use or disclose” personal information for another purpose, subject to the principle’s defined exceptions. Nebula designs its privacy practices around this purpose-limited standard.

Founding Programme Terms

Nebula Platform Pty Ltd. Published 25 July 2026. Effective when accepted electronically.

1. Application and electronic acceptance

The authenticated user who accepts these Founding Programme Terms is the Participant. These terms take effect when the Participant accepts them electronically for the workspace selected at activation (Founding Workspace). They supplement the Terms of Service governing the Participant's account and use of the Founding Workspace. Capitalised terms have the meaning given in those Terms of Service unless these terms state otherwise.

2. Eligibility and activation

An authenticated member of an eligible Founding Workspace may accept these terms and activate Founding Business while places remain. Acceptance is recorded against the Participant's account and the named Founding Workspace. It activates the no-charge Founding Period only, creates no payment obligation and does not commit the organisation to a subscription or continuation. No handwritten or drawn signature is required.

3. Founding Period and Business access

Subject to acceptance, Nebula grants the Founding Workspace access to full Business at no charge for the Founding Period displayed before activation. The Founding Period starts when acceptance is recorded. No payment card, fee or automatic charge is required for that access.

4. Programme participation

The Participant agrees to use Nebula in good faith for real engagement delivery and to provide reasonable practical feedback. Nebula will provide priority responses during the Founding Period, remain responsible for product decisions and may use that feedback to inform product priorities.

5. User Content and use of the Platform

Users retain ownership of their documents, engagement records and other User Content. Nebula processes User Content only to provide, support and secure the Platform and carry out user-requested actions, in accordance with the Terms of Service and Privacy Policy. Nebula does not sell or rent User Content, use it for advertising, or use it to train, fine-tune or improve artificial intelligence models. Approved service providers process User Content only as needed to deliver the Platform.

6. Optional six-month continuation offer

After the Founding Period, the organisation associated with an eligible Founding Workspace may purchase a fixed six-calendar-month Business term at a 50% discount to the standard Business price presented for that offer. The offer must be accepted within the displayed continuation window and the full discounted amount, together with any applicable GST, must be paid in one upfront payment. The accepted price is fixed for that six-calendar-month term. The purchase is optional, separate from the Founding Period and subject to any rights that cannot be excluded under applicable law.

7. Expiry and no automatic renewal

The Founding Period and any discounted six-month Business term do not renew automatically. When the Founding Period ends, the Founding Workspace moves to Free unless the organisation separately chooses the optional continuation offer or another paid plan. When a discounted six-month Business term ends, the Founding Workspace moves to Free unless the organisation separately purchases a paid plan under the terms presented at that time.

8. Feedback and intellectual property

Nebula may use non-confidential feedback to improve and market the Platform without attribution. Ownership of User Content remains unchanged. All rights in the Platform and its improvements remain with Nebula and its licensors.

9. Suspension and ending participation

The Participant may stop using the programme at any time. Nebula may suspend or revoke a founding place for misuse, material breach of these terms or the Terms of Service, or sustained non-participation. The Founding Workspace then moves to Free, subject to the access, export, retention and termination provisions in the Terms of Service.

10. Priority, changes and governing terms

If these terms conflict with the Terms of Service, these terms prevail only for the Founding Period and optional continuation offer. The Terms of Service govern all other matters, including liability, dispute resolution and governing law. Nebula may amend these terms for future acceptances. A material change to an accepted Founding Period or continuation offer requires the Participant's agreement unless the change is required by law.
